With the advent of California Civil Code Section 1938, the hope was that in California there would be a decrease in the number of ADA claims brought against landlords and tenants. However, the number of these claims continues to increase dramatically. This lively panel presentation brings together a transactional lawyer and a litigator to discuss standard lease provisions dealing with ADA and state and local disability access laws and provide an analysis of how these provisions are typically negotiated in leases and litigated between landlords and tenants.
